Tesco store worker? Or worked for Tesco in the last 6 years?

Join the claim

Why has this happened?

The Equal Pay Act requires employers to pay male and female employees equally for the same work. However, Tesco has been paying shop floor workers less than their warehouse counterparts.

We consider this an injustice. That’s why we’re advocating for all Tesco employees whose hard work and dedication have been undervalued – and on a no-win no-fee basis. We are committed to holding them accountable and helping hardworking employees like you get the pay you deserve. Thousands have already joined our campaign to secure fair pay.

Will the claim affect your job?

You might be worried about the impact of a claim on your current employment. As far as we know, no claimants have been penalised or fired for making a claim.
Tesco has stated they will defend all claims vigorously, and it could take months or even years to resolve. However, Tesco has promised to ensure it does not subject any employees to adverse treatment because of bringing an equal pay claim. And it would be unlawful to do so.

FAQs

Why should I participate in the claim?
Pursuing fair pay for equal work

You have the right to demand equal pay. The law mandates that employees should receive equal pay for work of equal value, and we believe Tesco has violated this law by underpaying you  and other store workers for years. A successful claim may entitle you to:

  • Back pay for up to 6 years.
  • Additional pay for the hours you work as your claim progresses if you're still employed in a Tesco store in an hourly-paid role.

Most claims will be worth over £1,000, though the value will depend on your hourly rate and length of service.

Potential to boost your future earnings

If your claim succeeds, it won't just entitle you to back pay for past hours worked. You may also receive an increased hourly rate for future work.

Accountability

We believe Tesco has been paying different wages for equal work,  favouring men over women. By filing a claim, you’ll help bring attention to the critical issue of equal pay.

Strength in unity

Joining the claim means you'll be part of a collective effort with thousands of Tesco shop floor workers, striving to change employers’ attitudes and ensure fair pay in the future.

How much could Tesco owe me?

You might have been underpaid by £1 to £3 per hour. Multiplying this by the hours worked over the last six years  can give you an estimate of your claim’s worth. Most claimants are seeking more than £5,000.

The value of your claim depends on various factors, including hours worked, duration of employment, and the appropriate distribution role for comparison.

If you're still employed at Tesco, we will also seek to increase your hourly rate and future pay.

Will I lose my job or be penalised for making a claim?

To the best of our knowledge, no staff members have faced disciplinary actions or termination for participating in the Equal Pay Claim.

It's unlawful for your employer to discriminate against you for filing this claim. If you believe you're being treated unfairly due to your claim, reach out to us right away.

We know that filing a claim can be intimidating, but tens of thousands of individuals are already stepping up to recover lost wages, so you're not alone in this.

I'm a man, can i claim?

Yes. Your claim will be based on the idea that if women doing store work succeed in their claim for higher pay, it would be unfair if male store workers’ pay did not also rise. Although your claim depends on female claimants winning theirs, you can lodge your claim now alongside the women’s claims.

Am I eligible to join the Tesco Fair Pay Claim?

You are eligible if you:

  • Work for one of the following supermarkets now or have in the last 6 yeears(5 in Scotland): Tesco, Morrisons, Asda, Sainsbury’s.
  • Your job was in the store of any of these supermarkets.
  • You were paid an hourly rate.
What are the costs?

The claim is no win, no fee. You will only pay if your claim is successful, provided you comply with our retainer terms. There are no upfront costs to join the claim, and we will cover all expenses associated with pursuing your claim, including court and expert fees.

We operate on a ‘no win, no fee’ basis. If your case is unsuccessful, you won’t pay anything. If you win, we will charge 22.5% plus VAT, along with any disbursements.

I’m a former Tesco Employee. Could I claim?

Yes, you can claim against Tesco provided you worked there within the last six years.  You can only claim for the hours that you worked for Tesco in those six years.

If you only worked a few months in the six year period then your claim may be too small for us to accept.  We will let you know when you sign up.

I have worked at another supermarket. Can I make two claims?

Yes, you can! If your employment ended within the last 6 years, you can join any of the claims. There is no maximum limit to the number of claims you can sign up for.

Which other supermarkets are facing the claim?

Many supermarkets and high street shops are facing equal pay claims. We are representing clients bringing claims against Tesco, Asda, Sainsbury’s, and Morrisons. There have been successes in all the equal pay cases so far, although none have yet reached their conclusion.

Do I need to be a union member to claim?

No. You can join the claim whether or not you are a union member.
